1. Scope of Services

Tourfic Services provides professional digital services including, but not limited to, website development, plugin configuration, customization, content creation, technical SEO, automation setup, UI/UX design, hosting support, and related consulting services.

Service scope, deliverables, timelines, and pricing are defined in individual proposals, service packages, or written agreements.

2. Limitation of Liability

To the fullest extent permitted under the laws of Ontario and Canada, Pixelfic Inc. and Tourfic Services shall not be liable for any direct, indirect, incidental, consequential, or special damages, including loss of data, revenue, business opportunities, or reputation arising from the use of our services or deliverables.

Clients are responsible for reviewing deliverables and maintaining their own backups, business continuity plans, and operational safeguards.

3. Payments and Project Initiation

Projects typically begin after confirmation of payment or agreed deposit.

Failure to provide required access, content, feedback, or approvals in a timely manner may result in project delays.

All fees are quoted in advance and may vary depending on project scope changes requested after work has commenced.

4. Intellectual Property

Unless otherwise agreed in writing:

  • Clients retain ownership of final website content and assets provided by them.
  • Custom code, frameworks, processes, tools, and proprietary methodologies developed or used by Pixelfic Inc. remain our intellectual property.
  • We reserve the right to showcase completed work in our portfolio for promotional purposes unless confidentiality is agreed separately.
  • Clients must ensure they have proper rights or licenses for all third-party content, images, fonts, videos, and branding materials supplied to us.

5. Service Availability and Performance

While we strive to deliver reliable and high-quality services, we do not guarantee specific business outcomes such as search rankings, traffic growth, sales performance, or platform compatibility with all third-party systems.

Hosting performance, third-party plugins, APIs, payment gateways, and external service providers are outside our direct control.

6. Revisions and Customization

Service packages may include a defined number of revisions. Additional changes or new feature requests beyond the agreed scope may require a separate quotation.

7. Refund Policy

Due to the customized nature of digital services, refunds are not guaranteed once significant project work has commenced. Refund eligibility, if applicable, will be determined based on project stage, work completed, and mutual agreement.

8. Account Suspension or Service Refusal

Pixelfic Inc. reserves the right to refuse or discontinue services in cases including but not limited to:

  • Abusive or unethical behavior
  • Fraudulent payment activity
  • Requests involving unlawful, harmful, or prohibited content
  • Activities that may damage our brand, systems, or clients

9. Pricing and Service Changes

We reserve the right to modify service pricing, packages, features, or availability at any time without prior notice. Existing confirmed projects will continue under the agreed terms.

10. Confidentiality

We respect client confidentiality and will not disclose sensitive project information without consent, except where required by law.

11. Indemnification

You agree to indemnify and hold harmless Pixelfic Inc., its directors, employees, partners, and affiliates from any claims, damages, or liabilities arising from your use of our services or breach of these Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
